OUR MOTOR VEHICLE ACCIDENT CASE RESULTS

$2,300,000 Wrongful Death

Our client was an elderly man of modest means who was killed in a car accident by a reckless driver. The other driver claimed our client was at fault for causing the accident. After hard-fought litigation, we obtained a financial settlement that provided financial security for his widow and college funds for his grandchildren.

$2,000,000 Motorcycle Accident

Our client was injured in a motorcycle accident when another car crashed into him at an intersection. He suffered a serious brain injury that left him permanently disabled.

At first, the insurance company told his family there was only $100k in coverage to pay for his medical bills and replace his income for his family. However, our investigation revealed additional insurance coverages that provided him and his family with much-needed financial resources. Now, he doesn’t have to worry about taking care of his family while he continues to regain his health.

$2,000,000 Bicycle Accident

A teenager struck our client while our client was riding his bicycle around his neighborhood. Our client ultimately died from his injuries. The teenager had minimum insurance limits, but using creative legal strategies, we were able to unlock millions of additional coverage for our client’s family.

Our client’s widow was able to retire early so she could spend more time with her family, while our client’s children could get a headstart on retirement and become first-time homeowners. No amount of money will ever replace a loved one, but we were able to pull a few blessings from this very tragic situation.

$800,000+ Semi-Truck Accident

Our client was hit on the side of her car by a fully loaded semi-truck when the truck driver made a last-second lane change to avoid taking an exit on the highway. Our client suffered spinal injuries that were so severe she couldn’t work in her job as a housecleaner anymore, and she didn’t have health insurance to get the treatment she needed to get better.

We were able to help her find medical providers who would work with her insurance situation. Then we got her a settlement that paid off her medical bills and put a large amount in her pocket so she could start a new career as a real estate investor. She’s doing well now.

$300,000 Car Accident

Our client was t-boned by a young driver when he was passing through an intersection on his way home from work. He suffered a serious concussion and soft tissue orthopedic injuries that made it difficult for him to work in his landscaping job.

The insurance company initially offered him $10,000, but after we got involved, we were able to get the full limits of the at-fault driver’s insurance policy. He used the money to support himself and his family while transitioning to a less labor-intensive career.

COMPENSATION FOR YOUR MOTOR VEHICLE ACCIDENT CLAIM

When pursuing a Kansas City motor vehicle accident claim, damages typically fall into two main categories: economic and non-economic.

ECONOMIC DAMAGES

These are tangible costs directly associated with the accident and can be easily quantified:

  • Medical Expenses: This includes all costs for treating your injuries, from hospital bills to ongoing therapy, as well as future medical expenses if long-term care is needed.
  • Lost Wages and Future Earnings: Compensation includes income lost while you’re unable to work during recovery and any future earnings if your ability to work is permanently impacted.
  • Property Damage: Reimbursement for vehicle or personal property damage, including repair or replacement costs.

NON-ECONOMIC DAMAGES

These are more subjective and relate to the impact of the accident on your life:

  • Pain and Suffering: Compensation for the physical pain and emotional distress caused by the accident. This can include both immediate and long-term suffering.
  • Emotional Distress: Covers the mental anguish and psychological impact of the accident, such as anxiety, depression, or post-traumatic stress disorder (PTSD).
  • Loss of Enjoyment: If your injuries prevent you from enjoying activities and hobbies you once loved, you may receive compensation for this loss.
  • Loss of Consortium: If your injuries affect your relationship with your spouse or partner, you might claim damages for the impact on companionship, affection, and support.

PUNITIVE DAMAGES

In some cases, you may be eligible for punitive damages. Unlike other damages that compensate for your losses, punitive damages aim to punish the at-fault party for their especially reckless or intentional behavior. These damages are meant to deter future misconduct and are typically awarded in cases of severe negligence or gross misconduct.

HOW MUCH IS MY MOTOR VEHICLE ACCIDENT CASE WORTH?

Curious about the value of your accident case? In this video, we’ll walk you through the main factors that affect your case’s value and explain what you can expect when pursuing compensation.

UNDERSTANDING KANSAS CITY MOTOR VEHICLE ACCIDENT LAWS

MISSOURI IS AN AT-FAULT STATE

In Missouri, motor vehicle accidents follow an “at-fault” system, meaning the driver responsible for the accident must cover the damages. Typically, the at-fault driver’s insurance company pays for expenses like medical bills, property damage, lost wages, and other related costs.

COMPARATIVE FAULT

When it comes to motor vehicle accidents in Kansas City, determining fault isn’t always clear-cut. Often, both drivers share some responsibility for the accident. This is where Missouri’s comparative fault rule comes into play.

Under this rule, if you’re partially at fault for an auto accident, your compensation is reduced by the percentage of your fault. For instance, if you’re found to be 20% at fault and your damages total $10,000, you would receive $8,000 after the reduction.

STATUTE OF LIMITATIONS FOR MOTOR VEHICLE ACCIDENT CLAIMS

In Missouri, you have five years from the date of a motor vehicle accident to file a claim.

For wrongful death cases related to a motor vehicle accident, the deadline is three years.

If a defective or unsafe road condition maintained by a government entity contributed to the car accident, you must notify the government of your injury claim within 90 days.

If you miss these deadlines, you lose the legal right to pursue compensation for your injuries. Don’t delay – contact Empower Injury Law today for a free consultation.

WHAT IF THE AT-FAULT DRIVER HAS NO INSURANCE?

Missouri requires all drivers to carry auto insurance, but unfortunately, some fail to comply or have expired policies. Since Missouri is an “at-fault” state, the driver responsible for the accident is supposed to cover the costs. However, if the at-fault driver lacks insurance, they may not have the means to pay for medical bills, property damage, and other expenses.

In this situation, it’s important to check your insurance policy. If you have uninsured motorist (UM) or underinsured motorist (UIM) coverage, you can file a claim with your insurance company to seek compensation for the accident. Missouri’s Motor Vehicle Financial Responsibility Law requires all auto policies to provide at least $25,000 in coverage for each person injured in an accident, and $50,000 in total coverage for each accident.

In some circumstances, you can maximize your UM coverage by “stacking” the limits of each vehicle insured on your policy. For example, if a driver insures two cars with UM limits of $25,000/$50,000, stacking would double their coverage to $50,000/$100,000.

That’s why if you have significant injuries, it is important to work with a lawyer who understands insurance policies and knows how to unlock all available coverages.

COMMON MOTOR VEHICLE ACCIDENT INJURIES

SHOULD I SEE A DOCTOR AFTER A KANSAS CITY MOTOR VEHICLE ACCIDENT?

Even if you feel fine after an accident, getting a medical exam as soon as possible is essential. Adrenaline and emotions can mask injury symptoms, making it easy to dismiss them as stress-related. However, these signs could point to something more serious. Documenting any injuries right away is essential for supporting your personal injury claim.

COMMON CAUSES OF MOTOR VEHICLE ACCIDENTS IN KANSAS CITY

Motor vehicle accidents are a major concern in Kansas City, happening by the thousands each year. Here’s a look at the leading causes of traffic accidents in Kansas City:

Distracted Driving

Distracted driving is a leading cause of car accidents in Missouri. According to the Missouri Department of Transportation, between 2013-2022, there were nearly 200,000 distracted driving-related crashes in Missouri, resulting in at least 800 fatalities.

Speeding

Speeding is another major factor in motor vehicle accidents. Excessive speeding is linked to about 36% of all traffic fatalities in Missouri. Higher speeds reduce the driver’s reaction time and increase the severity of crashes, making speeding a significant risk factor on Kansas City roads.

Impaired Driving

Driving under the influence of drugs or alcohol remains a serious problem. According to the Missouri Coalition for Roadway Safety, impaired driving is responsible for 18% of traffic fatalities in Missouri.

Running Red Lights and Stop Signs

Ignoring traffic signals, such as running red lights and stop signs, leads to many accidents in Kansas City. The Kansas City Police Department has identified the following intersections as the most dangerous for car accidents:

  • Gregory and U.S. 71 Highway
  • 55th and U.S. 71 Highway
  • 75th and Ward Pkwy
  • Independence and Van Brunt
